ParamotorPro LLC – Terms of Service

Effective Date: May 2026

These Terms of Service (“Terms”) govern the use of services, products, training programs, events, instruction, equipment, and websites operated by ParamotorPro LLC (“ParamotorPro,” “we,” “us,” or “our”). By purchasing, enrolling in, participating in, accessing, or using any ParamotorPro service or product, you agree to these Terms.


1. Assumption of Risk

Powered paragliding, paramotoring, paragliding, ground handling (kiting), free flight, aviation activities, and all related training activities involve significant and inherent risks.

These risks include but are not limited to:

  • Serious bodily injury

  • Permanent disability

  • Equipment failure

  • Property damage

  • Mid-air collisions

  • Hard landings

  • Weather-related incidents

  • Loss of control

  • Pilot error

  • Instructor error

  • Mechanical malfunction

  • Death

By participating in any ParamotorPro activity, the participant voluntarily and knowingly assumes all risks associated with these activities.

Participants understand that aviation activities are inherently dangerous even when proper instruction, equipment, and safety procedures are followed.


2. Eligibility Requirements

Participants must:

  • Be at least 18 years old or have written parental/legal guardian consent

  • Be physically and mentally capable of participating safely

  • Follow instructor directions at all times

  • Provide truthful and accurate information during enrollment

  • Comply with all applicable FAA regulations and local laws

ParamotorPro reserves the right to refuse or terminate training or participation at any time for safety reasons.


3. Training Disclaimer

ParamotorPro provides flight training, coaching, and educational guidance only.

Completion of training does not guarantee:

  • Pilot competency

  • Solo readiness

  • Safety

  • Certification

  • Continued instruction

  • Equipment mastery

  • Freedom from accidents or incidents

The participant remains solely responsible for all decisions made before, during, and after flight activities.


4. FAA Compliance

Participants are solely responsible for understanding and complying with all applicable aviation regulations, including but not limited to:

  • FAA FAR Part 103

  • Airspace restrictions

  • Local aviation laws

  • Temporary flight restrictions (TFRs)

  • Airport and controlled airspace requirements

ParamotorPro does not guarantee the legality of any flight conducted by participants outside supervised training.


5. Equipment Purchases

All equipment purchases are subject to availability.

ParamotorPro does not guarantee:

  • Specific delivery dates

  • Manufacturer timelines

  • Product availability

  • Color availability

  • Performance expectations

Equipment specifications may vary from manufacturer descriptions.

Used equipment may contain cosmetic wear, prior repairs, or signs of use.

The customer acknowledges that all aviation equipment carries inherent risk even when properly manufactured and maintained.


6. No Warranty

Except where prohibited by law, all products, services, and instruction are provided:

“AS IS” and “AS AVAILABLE”

ParamotorPro disclaims all warranties, express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Performance guarantees

  • Safety guarantees

No oral or written information provided by ParamotorPro creates any warranty unless explicitly stated in writing.


7. Deposits and Payments

Training deposits and product deposits may be non-refundable.

Unless otherwise agreed in writing:

  • Deposits reserve training dates, equipment allocations, or services

  • Missed training dates may result in forfeiture of deposits

  • Refunds are issued solely at ParamotorPro’s discretion

Customers are responsible for all payment processing fees, chargeback fees, taxes, shipping fees, and applicable duties.


8. Weather and Schedule Changes

Training and flight activities depend heavily on weather conditions.

ParamotorPro reserves the right to:

  • Delay training

  • Reschedule lessons

  • Cancel flights

  • Adjust schedules

  • Modify locations

for any safety-related reason.

Weather delays or cancellations do not automatically qualify for refunds.


9. Media Release

Participants grant ParamotorPro permission to photograph, record, or film participants during activities.

ParamotorPro may use this media for:

  • Marketing

  • Social media

  • Advertising

  • Website content

  • Promotional materials

  • Educational content

without compensation unless otherwise agreed in writing.

Participants may request exclusion from promotional media in writing before training begins.


10. Limitation of Liability

To the maximum extent permitted by law, ParamotorPro LLC, its owners, instructors, contractors, affiliates, employees, and representatives shall not be liable for:

  • Injury

  • Death

  • Emotional distress

  • Property damage

  • Economic loss

  • Business interruption

  • Lost profits

  • Indirect damages

  • Consequential damages

  • Incidental damages

arising from participation in any activity, use of equipment, website access, or training services.

If liability is imposed despite these limitations, total liability shall not exceed the amount paid directly to ParamotorPro for the applicable service or product.


11. Indemnification

Participants agree to indemnify and hold harmless ParamotorPro LLC and its affiliates from any claims, lawsuits, damages, liabilities, or expenses arising from:

  • Participant negligence

  • Violation of laws or FAA regulations

  • Improper equipment use

  • Unsafe conduct

  • Third-party claims caused by participant actions

including attorney fees and legal expenses.


12. Website Use

Users of ParamotorPro websites agree not to:

  • Misuse website functionality

  • Attempt unauthorized access

  • Copy or reproduce content without permission

  • Use the website for unlawful purposes

  • Submit false or fraudulent information

All website content remains the property of ParamotorPro LLC unless otherwise stated.


13. Intellectual Property

All branding, logos, images, videos, training materials, text, graphics, and digital content created by ParamotorPro remain the intellectual property of ParamotorPro LLC.

Unauthorized reproduction or commercial use is prohibited.


14. Shipping and Delivery

Shipping estimates are not guaranteed.

Customers are responsible for:

  • Providing accurate shipping information

  • Inspecting shipments upon delivery

  • Filing claims for shipping damage where applicable

ParamotorPro is not responsible for delays caused by carriers, customs, manufacturers, weather, or force majeure events.


15. Lodging Disclaimer

If lodging accommodations are provided or arranged:

  • Guests are responsible for their own conduct and belongings

  • ParamotorPro is not liable for theft, injury, accidents, or damages occurring at lodging locations

  • Guests must comply with all lodging rules and local laws


16. Termination of Services

ParamotorPro reserves the right to terminate or refuse services at any time for reasons including:

  • Unsafe behavior

  • Harassment

  • Substance abuse

  • Failure to follow instructions

  • Nonpayment

  • Conduct deemed dangerous or disruptive

No refund is guaranteed upon termination.


17. Force Majeure

ParamotorPro shall not be liable for delays, failures, or interruptions caused by events outside reasonable control, including:

  • Weather

  • Natural disasters

  • Government restrictions

  • Airline disruptions

  • Supply chain issues

  • Manufacturer delays

  • Internet outages

  • Emergencies


18. Governing Law

These Terms shall be governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved in the courts located within Utah.


19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain fully enforceable.


20. Modifications

ParamotorPro reserves the right to modify these Terms at any time.

Updated Terms become effective upon posting to the website.

Continued participation or use of services constitutes acceptance of updated Terms.

By purchasing products, enrolling in training, participating in events, or using ParamotorPro services, the participant acknowledges that they:

  • Have read these Terms

  • Understand the risks involved

  • Voluntarily agree to these Terms

  • Assume all associated risks

  • Release ParamotorPro from liability to the fullest extent permitted by law
